Client Terms of Service

These Terms of Service (“Agreement”) govern communication coaching, public speaking training, workshops, keynote presentations, and related services (collectively, “Services”) provided by FWintersGeo Inc (“Frank”). By clicking “I Agree,” booking my services, or making a deposit or full payment, the client (“Client”) accepts and is bound by these terms.

1. Nature of Services

Frank provides professional guidance, training, and keynote presentations related among other topics, communication and storytelling. The Client acknowledges these Services are educational and advisory in nature. Frank does not exercise control over—nor does he guarantee–the Client’s application of these insights in real-world scenarios.

2. No Guarantee of Outcomes

Success in public speaking and communication is subjective and dependent on many variables. The Client understands that:

  • Frank does not guarantee specific results, such as career advancement, financial gain, or specific audience reactions.
  • The effectiveness of any communication is influenced by external factors, including audience sentiment, timing, and the Client’s personal execution.

3. Client Responsibility & Content Ownership

The Client retains sole responsibility for:

  • The final content of their speeches, presentations, and messages.
  • Ensuring their communications comply with all applicable laws (e.g., copyright, defamation, and professional ethics).
  • Any professional or reputational consequences resulting from their statements.
  • Clients must be at least 18 years of age.

4. Intellectual Property

  • Frank’s Materials: All workshops, frameworks, handouts, and digital materials provided by Frank remain the intellectual property of FWintersGeo Inc. They are licensed to the Client for personal/internal use only and may not be resold or redistributed without written consent.
  • Client Materials: Frank claims no ownership over the Client’s specific communication or proprietary business data shared during coaching.

5. Limitation of Liability

To the maximum extent permitted by law, FWintersGeo Inc and its agents shall not be liable for:

  • Indirect, incidental, or consequential damages including loss of profits.
  • Errors or omissions in the Client’s final delivery of materials. 
  • Total Liability: In any event, Frank’s total financial liability is strictly limited to the actual amount paid by the Client for the specific service in question.

6. Professional Boundaries

The Client acknowledges that Frank is not a licensed attorney, medical professional, or mental health counselor. Coaching is not a substitute for legal or medical advice or psychotherapy.

7. Cancellation, Rescheduling, and Refunds

To maintain a professional schedule and ensure quality of service, the following policies apply to all bookings:

  • 7.1 Individual Coaching Sessions:
    • Rescheduling: Clients may reschedule a session with at least 24 hours’ notice at no additional cost.
    • Late Cancellations: Cancellations or rescheduling requests made with less than 24 hours’ notice will result in the forfeiture of that session (or a 100% “No-Show” fee).
  • 7.2 Workshops and Keynote Addresses:
    • Deposit: A non-refundable deposit of 25% is required to secure the date on Frank’s calendar.
    • Full payment is due 30 days prior to the event.
    • Cancellation by Client: If the Client cancels the event:
      • 30+ days notice: The deposit is retained, but no further fees are due.
      • Less than 30 days notice: The Client is responsible for 50% of the total quoted fee.
      • Less than 7 days notice: The Client is responsible for 100% of the total quoted fee.
    • Travel Expenses: Any non-refundable travel expenses (flights, hotel deposits) already incurred by Frank at the time of cancellation shall be reimbursed by the Client in full, regardless of the notice period.
  • 7.3 Cancellation by Frank:
    • In the unlikely event that Frank must cancel due to an emergency or “Act of God,” FWintersGeo Inc will offer the Client the choice of a full refund for that specific service or a priority rescheduling of the date. Frank is not liable for any third-party costs (e.g., venue rental) incurred by the Client.

7.4 No Refunds for Completed Work: * Once a coaching session has been held or a keynote delivered, no refunds will be issued.
